In order to avoid fraud, only make prepayments (reservations or deposits) using a credit card (or any other card that does not require a PIN number for online purchases) or PayPal. Never make an advanced payment using cash, checks, money orders or bank transfers. Learn why.

Rental Agreement
VACATION RENTAL CONTRACT
This vacation rental contract is a legal agreement between Consolidated Investment Group, LLC. DBA Sunspot Miami Rentals (also referred to as the “Homeowners” and “Landlord” and “Property Manger”) and you, the Renters (also referred to as “Tenants” and “Guests”). This contract is entered into agreement as of the date when the Renters place their reservation online and the reservation is screened and accepted by the Homeowner. 1801 Collins Ave Unit 1514, Miami Beach FL 33139

In order to secure your reservation, we must receive 25% deposit and signed rental contract within [24] hours of booking. Full payment is due 30 days prior to check-in. If the balance payment is not send 30 days prior to checkin, owner reserves the right to forfeit deposit and re-rent property.

Cleaning Policy:
The Vacation Rental must be left reasonably clean with all inventory items left in the condo to receive a full security deposit refund. Deposit is returned to you (if The Vacation Rental is left clean, with no damage, not smoked in, and no items missing) within 5 to 7 days after departure. If Security deposit is in the form of a hold on a credit card the hold will be released after checkout.

Linen Policy:
Landlord will supply 2 bath towels per person per week
We supply 1 set of clean sheets on the bed upon arrival. (In case of a spill or upon request we will supply a clean set of sheets.)
The hotel provides pool towels for use when at the pool.

Check-in and Out times:
11am is check out and 3pm is check in.
If you need a early checkin or late check out please let us know 24 hours in advance. If there is not someone else checking in right away we will work with you.

Tax Policy:
Miami Dade county requires us to charge an 13% Occupancy Tax.

Reservation Policies:

We, the Renters (also referred to as “Tenants” and “Guests”) agree to the following:

1) Tenant will leave all linens and towels in the room after departure.
2) Tenant agrees to review the inventory list and report to landlord with 6 hours of check in if any items on inventory list are missing from the condo.
3) Maximum occupancy is 4 adults.
4) Tenant will notify the owners of any damage upon arrival.
5) Tenant will hold the owners harmless from any and all bodily injury and/or property damage incurred on the property arising out of our negligent acts or omissions. See disclaimer below.
6) We will forfeit any portion of the security/damage deposit that is reasonably attributable to broken, damaged, or missing items. We understand that if damage to the unit exceeds the security deposit our credit card will be charged for the excess cost.
7) All Cancellations received more than 45 days prior to check in will receive a full refund.
8) Cancellations received between 0 and 45 days before check-in will forfeit all monies paid. Note: We recommend getting trip insurance to cover you in the event you need to cancel with less than 45 day notice. InsureMyTrip.com has a policy that will reimburse you for all funds in the event you need to cancel a trip for any reason. Their number is 800-487-4722.
9) There are no refunds for early departure.
10) There are no refunds for snow, hurricanes or weather conditions.
11) All rental monies are due 30 days prior to arrival.
12) Tenants will not hold the owners liable for theft or damage to any of our property or belongs while staying at the condo.
13) Tenants will not hold the owners responsible for any items left after our check out.
14) Lost keys will incur replacement costs.
15) This is not a party Condo.
16) This is a NON SMOKING vacation rental.
17) Parking is not included in the room rental. There are several parking lots in the area charging $15 to $20 per day. You may also park on the street at a cost of $1 per hour. Miami Beach uses meters that take Dollars, coins or credit cards.
18) Tenants will be completely responsible for any and all damage to the condo or property and agree to have owner's charge any damages to credit card used to book the reservation.
19) Check-in is at 3:00 pm and check-out is 11:00 am. A late check-out is subject to extra rental charges.
20) Tenant must be at least 18 years of age to book this Vacation Rental.
We reserve the right to refuse service to anyone. Landlord will not be responsible for accidents or injury to guests or for loss of their money, jewelry or valuables of any kind.

Disclaimer:

Renters understand that the Homeowners are not responsible for any personal injury caused by use of the room. And further that the homeowners are not responsible for any personal injury or loss or damage to tenants’ property caused directly or indirectly from foul, inclement weather conditions, Acts of God or nature, failure of heat, accidents related to fire, heaters, stoves, or any unforeseeable circumstances.

All reservations are subject to a $250 damage deposit hold to be placed on credit card used to book reservation 1 day before check in. Damage hold is required during Spring break, Winter Music Conference, New Years, Memorial week, and any other time periods the landlord deems it necessary. Hold will be released after checkout if unit and/or property is not damaged. If tenant would like to know if their dates require a Credit Card damage hold please contact landlord.

All parties hereby agree that in the event of dispute, and mediation and/or legal proceedings are necessary, all filings, hearings, and court actions shall take place and be filed in the county where the property is located and also agree that prevailing party in the suit or mediation shall be entitled to reimbursement of reasonable attorney fees and costs incured to file the lawsuit from the losing party.

In the event that room is uninhabitable or unavailable for the time period booked landlord may either refund tenants full monies paid or move tenant to a comparable room.


Under no circumstances will tenants or their guests hold the owners of the Vacation Rental responsible for any damages or claims of any kind resulting from their stay, except for intentional acts of harm.
This agreement and disclaimer applies to Renters and all guests in the Renters’ party.

I, the Renter, have read, understand, agree to, and will abide by this rental agreement and all conditions stated herein.
